  6. Software License for The Labyrinth 
  7.  
  8. IMPORTANT -- READ CAREFULLY: This License
  9. Agreement for The Labyrinth ("Game") is a legal
  10. agreement between you (either an individual or an
  11. entity) and RealNetworks, Inc. and Nonstop
  12. Entertainment (collectively "RN"). By clicking on
  13. the "Yes" button, installing, copying, playing or
  14. otherwise using the Game, you agree to be bound by
  15. the terms of this License Agreement. If you do not
  16. agree to the terms of this License Agreement,
  17. click on the "No" button and/or do not install the
  18. Game. 
  19.  
  20. THE TERMS OF THIS LICENSE AGREEMENT APPLY TO ALL
  21. VERSIONS OF THE GAME, INCLUDING SHAREWARE AND PAID
  22. VERSIONS. 
  23.  
  24. THE SHAREWARE VERSION OF THIS GAME MAY CONTAIN
  25. USE, FEATURE OR TIME LIMITATIONS. IN ORDER TO
  26. REMOVE SUCH LIMITATIONS, YOU MAY PURCHASE THE FULL
  27. VERSION OF THE GAME AT WWW.REAL.COM/GAMES.

  29. 1.    GRANT OF LICENSE. RN hereby grant to you a
  30. non-exclusive license to use the Game and
  31. Documentation, provided you may: (i) use the Game
  32. on any single computer; (ii) use the Game on a
  33. second computer so long as the first and second
  34. computers are not used simultaneously; (iii) copy
  35. the Game for back-up, archival purposes provided
  36. any copy must contain all of the original Game's
  37. proprietary notices.

  39. 2. LICENSE RESTRICTIONS. 
  40.  
  41. a)    You may not: (i) permit other individuals
  42. to use the Game except under the terms listed
  43. above; (ii) modify, translate, reverse engineer,
  44. decompile, disassemble (except to the extent that
  45. this restriction is expressly prohibited by law)
  46. or create derivative works based upon the Game or
  47. Documentation; (iii) copy the Game or
  48. Documentation (except for back-up or archival
  49. purposes); (iv) distribute, rent, lease, transfer,
  50. or otherwise transfer rights to the Game or
  51. Documentation; or (v) remove any proprietary
  52. notices or labels on the Game or Documentation.

  54. b) You agree that you shall only use the Game and
  55. Documentation in a manner that complies with all
  56. applicable laws in the jurisdiction in which you
  57. use the Game and Documentation, including, but not
  58. limited to, applicable restrictions concerning
  59. copyright and other intellectual property rights. 
  60.  
  61. c) The Game is for private use only. You may not
  62. use or display this Game for any commercial
  63. purpose. You may not distribute this Game to third
  64. parties in any manner. 
  65.  
  66. 3.    COPIES OF SOFTWARE AND ENHANCEMENTS. If
  67. you receive the first copy of the Game
  68. electronically and a second copy on physical media
  69. (e.g., CD, diskette, etc.), the second copy may be
  70. used for archival purposes only and may not be
  71. transferred to or used by any other person. This
  72. license does not grant you any right to any
  73. enhancement or update. 
  74.  
  75. 4. TITLE. Title, ownership, rights, and
  76. intellectual property rights in and to the Game
  77. and Documentation shall remain in RN and/or its
  78. suppliers. The Game is protected by the copyright
  79. laws of the United States and international
  80. copyright treaties. Title, ownership rights and
  81. intellectual property rights in and to the content
  82. accessed through the Game including any content
  83. contained in the Game media demonstration files
  84. shall be retained by the applicable content owner
  85. and may be protected by applicable copyright or
  86. other law. This license gives you no rights to
  87. such content.

  89. 5. DISCLAIMER OF WARRANTY: THE GAME AND
  90. DOCUMENTATION ARE PROVIDED AS IS WITHOUT WARRANTY
  91. OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY
  92. APPLICABLE LAW, RN FURTHER DISCLAIMS ALL
  93. WARRANTIES, INCLUDING WITHOUT LIMITATION ANY
  94. IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR
  95. A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE
  96. ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE
  97. OF THE GAME AND DOCUMENTATION REMAINS WITH YOU. TO
  98. THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN
  99. NO EVENT SHALL RN OR ITS SUPPLIERS BE LIABLE FOR
  100. ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT,
  101. SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER
  102. (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS
  103. OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS
  104. OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS)
  105. ARISING OUT OF THIS AGREEMENT OR THE USE OF OR
  106. INABILITY TO USE THE GAME, EVEN IF RN HAS BEEN
  107. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  108. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE
  109. EXCLUSION OR LIMITATION OF LIABILITY FOR
  110. CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE
  111. LIMITATION MAY NOT APPLY TO YOU.

  113. 6. TERMINATION: This License Agreement shall
  114. terminate automatically if you fail to comply with
  115. the limitations described in this license. No
  116. notice shall be required from RN to effectuate
  117. such termination. Upon termination, you must
  118. destroy all copies of the Game and Documentation. 
  119.  
  120. 7. U.S. GOVERNMENT RESTRICTED RIGHTS AND EXPORT
  121. RESTRICTIONS: U.S. GOVERNMENT RESTRICTED RIGHTS:
  122. This Game and Documentation may be provided with
  123. RESTRICTED RIGHTS. Use, duplication or disclosure
  124. by the Government is subject to restrictions set
  125. forth in subparagraphs (a) through (d) of the
  126. Commercial Computer Software--Restricted Rights at
  127. FAR 52.227-19 when applicable, or in subparagraph
  128. (c)(1)(ii) of the Rights in Technical Data and
  129. Computer Software clause at DFARS 252.227-7013,
  130. and in similar clauses in the NASA FAR supplement,
  131. as applicable. Manufacturer is RealNetworks,
  132. Inc./2601 Elliott, Suite 1000/ Seattle,
  133. Washington, 98121. You are responsible for
  134. complying with all trade regulations and laws both
  135. foreign and domestic. You acknowledge that none of
  136. the Game or underlying information or technology
  137. may be downloaded or otherwise exported or
  138. re-exported (i) into (or to a national or resident
  139. of) Cuba, Iraq, Libya, Sudan, North Korea, Iran,
  140. Syria or any other country subject to a U.S.
  141. embargo; or (ii) to anyone on the U.S. Treasury
  142. Department's list of Specially Designated
  143. Nationals or the U.S. Commerce Department's Denied
  144. Parties List or Entity List. By using the Game you
  145. are agreeing to the foregoing and are representing
  146. and warranting that (i) no U.S. federal agency has
  147. suspended, revoked, or denied you export
  148. privileges, (ii) you are not located in or under
  149. the control of a national or resident of any such
  150. country or on any such list, and (iii) you will
  151. not export or re-export the Game to any prohibited
  152. county, or to any prohibited person, entity, or
  153. end-user as specified by U.S. export controls.

  155. 8. MISCELLANEOUS. This License Agreement shall
  156. constitute the complete and exclusive agreement
  157. between us. The terms and conditions contained in
  158. this License Agreement may not be modified except
  159. in a writing duly signed by you and an authorized
  160. representative of RN. If any provision of this
  161. License Agreement is held to be unenforceable for
  162. any reason, such provision shall be reformed only
  163. to the extent necessary to make it enforceable,
  164. and such decision shall not affect the
  165. enforceability of such provision under other
  166. circumstances, or of the remaining provisions
  167. hereof under all circumstances. This License
  168. Agreement shall be governed by the laws of the
  169. State of Washington, without regard to conflicts
  170. of law provisions, and you hereby consent to the
  171. exclusive jurisdiction of the state and federal
  172. courts sitting in the State of Washington. Any and
  173. all unresolved disputes arising under this License
  174. Agreement shall be submitted to arbitration in the
  175. State of Washington; except that, to the extent
  176. that you have breached or have indicated your
  177. intention to breach this License Agreement in any
  178. manner which may cause continuing or irreparable
  179. harm to RN (including, but not limited to, any
  180. breach that may impact RN's intellectual property
  181. rights, or a breach by reverse engineering), RN
  182. may seek injunctive relief, or any other
  183. appropriate relief, in any court of competent
  184. jurisdiction. Any arbitration of a dispute under
  185. this Agreement shall be conducted under the rules
  186. then prevailing of the American Arbitration
  187. Association. The arbitrator's award shall be
  188. binding and may be entered as a judgment in any
  189. court of competent jurisdiction. This License
  190. Agreement will not be governed by the United
  191. Nations Convention of Contracts for the
  192. International Sale of Goods, the application of
  193. which is hereby expressly excluded.
